(Regulation and Development) Act, 2016, in the state of Kerala, India. The Kerala government notified the Kerala Real Estate (Regulation and Development) Rules, 2018, on 27 June 2018, to implement RERA in the state. RERA Kerala aims to bring transparency, accountability, and consumer protection to the real estate sector in the state. It requires builders and developers to register their projects with the regulatory authority, provide all the necessary details related to the project, including the land title, approvals, layout plan, and completion timeline, and adhere to the agreed-upon specifications. It also provides for the establishment of an adjudicating authority and an appellate tribunal to handle disputes between homebuyers and builders. RERA Kerala has brought about significant changes in the real estate sector in the state and has improved the overall confidence of homebuyers in the industry.

Also Read: Karnataka Rera Act

RERA Kerala: Vision & Objectives

Here is what Kerala RERA wants to do and how it wants to do it:

Protect the interests of those who got land.

Make sure everyone in the real estate business is held accountable.

Ensure everything is fair and try to cut down on fraud and delays.

There are rules and regulations for both the buyer and the seller.

Set up a fast way to settle disagreements

Be the same for both the allottee and the allotter.

Make sure you have better governance so investors can trust you.

Rera Kerala Rules

The RERA Kerala rules were published on June 27, 2018. They explain how the Real Estate (Regulation and Development) Act, 2016, should be used in the state. Here are some of the most important rules of RERA Kerala:

Registration of Real Estate Projects: Before selling or advertising real estate projects, builders and developers must register them with the Kerala Real Estate Regulatory Authority (KRERA). The registration application should have all the necessary information about the project, such as the land title, approvals, layout plan, and time frame for completion.

Deposit of 70% of the Funds in a Separate Bank Account: Builders and developers must put at least 70% of the money they get from buyers into a separate bank account that can only be used for construction and land costs.

Timely Completion: The RERA Kerala rules say that builders and developers must finish their projects on the schedule that was agreed upon. If there are any delays, the builder needs to make up for them.

Standardization of Agreements and Sale Deeds: Builders and developers are required to use standard agreements and sale deeds. This gets rid of ambiguity and makes it harder for fraud to happen.

Setting up KRERA: The Kerala Real Estate Regulatory Authority (KRERA) has been set up to make sure that RERA Kerala is used in the best way possible. KRERA has the power to regulate the real estate market, settle disputes, and punish builders and developers who don’t follow the rules.

Adjudicating Authority and Appellate Tribunal: The RERA Kerala rules say that a deciding authority and an appeals tribunal will be set up to handle disagreements between homebuyers and builders.

Penalties for not following the rules: Builders and developers who don’t follow the RERA Kerala rules can be fined up to 10% of the project cost.

These are some of the most important rules in RERA Kerala. The rules are meant to make the real estate industry in the state more open, accountable, and consumer-friendly. They have also made homebuyers more confident in the industry as a whole.

How to Search for RERA Kerala Registered Projects?

Investing in a property registered with RERA Kerala is a good idea to avoid project delays or fraud.
